Sleep Apnea VA disability rating criteria

The VA rates Sleep Apnea under 38 CFR 4.97, Diagnostic Code 6847. Below are the schedular rating levels exactly as written in the rating schedule.

These criteria come from a proposed rule and are not current law. Today the VA still rates this condition under the prior schedule. Do not assume you can file against the criteria below.

Rating levels

• 0%

  Asymptomatic, with or without treatment.

• 10%

  Incomplete relief of symptoms with treatment.

• 50%

  Treatment is ineffective, or the veteran is unable to use the prescribed treatment due to comorbid conditions, without associated end-organ damage.

• 100%

  Treatment is ineffective or cannot be used due to comorbid conditions, and the condition is associated with end-organ damage.
