Sleep Apnea VA disability rating criteria
The VA rates Sleep Apnea under 38 CFR 4.97, Diagnostic Code 6847. Below are the schedular rating levels exactly as written in the rating schedule.
Rating levels
0%
Asymptomatic but with documented sleep disorder breathing.
30%
Persistent day-time hypersomnolence.
50%
Requires use of breathing assistance device such as continuous airway pressure (CPAP) machine.
100%
Chronic respiratory failure with carbon dioxide retention or cor pulmonale, or; requires tracheostomy.
Proposed revision, not current law
The VA has proposed (but not finalized) new criteria for Sleep Apnea under 87 FR 8474 (proposed 2022-02-15). These are not current law. You cannot file against them today, and the schedule above still controls. They are shown only so you know a change is pending.

Asymptomatic, with or without treatment.
10% (proposed)
Incomplete relief of symptoms with treatment.
50% (proposed)
Treatment is ineffective, or the veteran is unable to use the prescribed treatment due to comorbid conditions, without associated end-organ damage.
100% (proposed)
Treatment is ineffective or cannot be used due to comorbid conditions, and the condition is associated with end-organ damage.
